(c) Restrictions. A basic purchase agreement may not stipulate or involve a government agreement to enter into future contracts or orders with the Contractor or to be used in any way to restrict competition. d) Orders. A contract agent representing an activity hired by the government listed in a basic contract may place orders for necessary supplies or services covered by that agreement. BOAs are agreements between ICE and local sheriffs in which ICE promises to pay sheriffs $50 for each immigrant they arrest and ice back, up to 48 hours in jail. The modification of a basic order contract does not retroactively affect orders previously placed under this contract. Materials, Supplies, Articles and Equipment (formerly Walsh Healy Act) – If the award is subject to materials, supplies, articles and equipment (FAR 22.60), select “Yes”. Construction Wage Rate Requirements (formerly Davis Bacon Act) – If the award is subject to the Construction Wage Rate Requirements (FAR 22 403-1), select Yes. If the premium is subject to the wage requirements of the construction industry, but does not include clause 52.222-6, select “No”. Select “Not applicable” if the reward does not meet the dollar threshold or is not intended for the construction, modification or repair (including painting and decoration) of public buildings or public works in the United States. The kit requirements of FAR 52.222-6, which are associated with the kit requirements (formerly Davis Bacon Act). This agreement can be used to expedite the award of contracts for dangerous supplies or services when certain items, quantities and prices are not known at the time of performance of the contract, but a significant number of requirements are likely to be purchased by the contractor.
